NEW DELHI: A Bill to overturn a Supreme Court order concerning certain safeguards against arrest under the SC/ST law was unanimously passed by the Lok Sabha on Monday.
The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Bill 2018 rules out any provision for anticipatory bail for a person accused of atrocities against SC/STs, notwithstanding any court order.
It also provides that no preliminary inquiry will be required for registering a criminal case and an arrest under this law would not be subject to any approval.
Replying to the debate on the Bill, minister of social justice and empowerment Thaawar Chand Gehlot asserted that the NDA government favoured reservation “and will continue to be in favour reservation for SC/ST”.
The amendment, he said, will strengthen the legislative provisions to protect SC/ST
The move to amend the Bill is being seen by the opposition as a reach-out by the BJP-led NDA government to the dalits, ahead of their proposed nationwide protest later this month to demand restoration of the provisions of the law which, the dalit groups allege, were diluted by a Supreme Court ruling of March 20.

एससी-एसटी एक्ट में तुरंत गिरफ्तारी और एफआईआर दर्ज करने के प्रावधान फिर से जोड़ने संबंधी बिल गुरुवार को राज्यसभा ने ध्वनि मत से पारित कर दिया। लोकसभा इसे पहले ही पारित कर चुकी है। राष्ट्रपति के दस्तखत होते ही यह कानून बन जाएगा। इससे गत 20 मार्च के सुप्रीम कोर्ट के फैसले से कमजोर हुआ एससी-एसटी एक्ट पुराने स्वरूप में आ जाएगा। बिल में एससी-एसटी एक्ट के तहत आरोपी को अग्रिम जमानत नहीं देने का भी प्रावधान है। बिल में प्रावधान है कि इस कानून के तहत आपराधिक केस दर्ज करने के लिए प्रारंभिक जांच जरूरी नहीं। गिरफ्तारी के लिए भी पहले से मंजूरी जरूरी नहीं।

  1. Still they are called downtrodden. Who did not accept the judgment of the Supreme Court and even who bowed the government in their feet. It will like giving the article 370 in the constitution.
